Analisis Metodologis Fikih Empat Mazhab terhadap Hukum Mengamalkan Pendapat Yang Tidak Otoritatif (Ghair Mu'tabar)

Abstract


This study aims to methodologically analyze the Islamic jurisprudence (Fiqh) perspectives of the four schools of thought (Mazhab) regarding the legality of practicing and the standards for non-authoritative opinions (ghair mu'tabar). This study seeks to prevent the misuse of non-authoritative opinions, which could threaten the methodological integrity of Islamic jurisprudence and create legal chaos in society. This research method uses a qualitative approach based on literature review. The primary data sources include the Qur'an, Hadith, and Usul Fiqh books from the Hanafi, Maliki, Shafi'i, and Hambali schools of thought. Some of this data was then analyzed using content analysis and a comparative-descriptive approach, comparing the four schools of thought regarding the hierarchy of opinions and the requirements for their authoritativeness. The results show that there is agreement among the four schools of thought regarding opinions that contradict the Qur'an, Hadith, Ijm?', and Qiyas Jal? as non-authoritative and should not be practiced. This problem in the literature of the Fiqh of the Four Schools of Thought is known as the term m? yunqa?u f?hi qa??’ al-q???.
